5) Data Processing When Opening a Customer Account and for Contract Processing
Pursuant to Art. 6 (1) point b GDPR, personal data will continue to be collected and processed if you provide them to us for the execution of a contract or when opening a customer account. Which data is collected can be seen from the respective input forms. It is possible to delete your customer account at any time. This can be done by sending a message to the above-mentioned address of the controller. We store and use the data provided by you for contract processing. After complete processing of the contract or deletion of your customer account, your data will be blocked in consideration of tax and commercial retention periods and deleted after expiry of these periods, unless you have expressly consented to further use of your data or a legally permitted further use of data has been reserved by our site, about which we will inform you accordingly below.
5.1 Bexio – Buchhaltungssoftware
Bei einem Kauf eines kostenpflichtigen Produkts oder einer Dienstleistung, werden die Kundenstammdaten für die Erstellung einer Rechnung an den ERP-Dienstleister Bexio weiterverschickt. Diese Daten werden explizit für die Rechnungsstellung benötigt und verarbeitet. Bei einer Account-Löschung auf dieser Website, dürfen diese Daten aufgrund der Rechnungs-Aufbewahrungspflicht des Schweizerischen Obligationenrecht Artikel 957ff. für eine Dauer von zehn Jahren nicht gelöscht werden.

6) Use of Your Data for Direct Advertising
6.1 Newsletter If you subscribe to our e-mail newsletter, we will send you regular information about our offers. The only mandatory information for sending the newsletter is your e-mail address. The indication of additional possible data is voluntary and is used to be able to address you personally. We use the so-called double opt-in procedure for sending the newsletter. This means that we will not send you an e-mail newsletter, unless you have expressly confirmed to us that you agree to the sending of the newsletter. You can unsubscribe from the newsletter at any time via the link provided in the newsletter or by sending a message to the responsible person named above. After your cancellation, your e-mail address will immediately be deleted from our newsletter distribution list, unless you have expressly consented to further use of your data or we reserve the right to use data in excess thereof, which is permitted by law and about which we inform you in this declaration.
If you have provided us with your e-mail address when purchasing products, we reserve the right to regularly send you offers for products similar to those already purchased from our range by e-mail. Pursuant to Section 7 (3) German law against unfair competition, we do not need to obtain separate consent from you for this. In this respect, data processing is carried out solely on the basis of our legitimate interest in personalized direct advertising pursuant to Art. 6 (1) point f GDPR. If you have initially objected to the use of your e-mail address for this purpose, we will not send you an e-mail. 6.2 Newsletter via MailChimp
Our e-mail newsletters are sent via the technical service provider, The Rocket Science Group, LLC d/b/a MailChimp, 675 Ponce de Leon Ave NE, Suite 5000, Atlanta, GA 30308, USA (http://www.mailchimp.com/), to whom we pass on the data you provided when registering for the newsletter. This disclosure is made in accordance with Art. 6 (1) point f GDPR and serves our legitimate interest in the use of an effective, secure and user-friendly newsletter system. Please note that your data is usually transferred to a MailChimp server in the USA and stored there.
MailChimp uses this information to send and statistically evaluate the newsletter on our behalf. For evaluation purposes, the e-mails sent contain so-called web beacons or tracking pixels, which represent single-pixel image files stored on our website. This allows us to determine whether a newsletter message has been opened and which links have been clicked on. In addition, technical information is recorded (e.g. time of retrieval, IP address, browser type and operating system). The data are raised exclusively in a pseudonymized format and are not linked with other personal data from you. A direct personal relationship is excluded. This data is used exclusively for statistical analysis of newsletter campaigns. The results of these analyses can be used to better adapt future newsletters to the interests of the recipients.

Furthermore, MailChimp can use this data according to Art. 6 (1) point f GDPR even on the basis of its own legitimate interest in the demand-oriented design and optimization of the service as well as for market research purposes, for example to determine from which countries recipients come. However, MailChimp does not use the data of our newsletter recipients to address those recipients or pass that data on to third parties.
To protect your data in the USA, we have concluded a data processing agreement (“Data-Processing-Agreement”) with MailChimp on the basis of the standard contractual clauses of the European Commission to enable the transmission of your personal data to MailChimp. 7) Processing of Data for the Purpose of Order Handling

The personal data collected by us will be passed on to the transport company commissioned with the delivery within the scope of contract processing, insofar as this is necessary for the delivery of the goods. 13) Rights of the Data Subject
13.1 The applicable data protection law grants you comprehensive rights of data subjects (rights of information and intervention) vis-a-vis the data controller with regard to the processing of your personal data, about which we inform you below:
- Right to information in accordance with article 15 GDPR: in particular, a right to receive information, have your personal data processed by us, the purposes of the processing, the categories of processed personal data, the recipients or categories of recipients; to which your data were disclosed or are the existence of a right to correction, cancellation, constraint processing, object to the processing, the planned storage period or the criteria for the determination of the storage period, complaint to a supervisor, the origin of your data, if it is not collected by us when you, the existence of an automated decision making including profiling, and any meaningful information about the involved logic and the specific scope and the intended effects of such processing, as well as your right to be informed as to which guarantees exist in accordance with article 46 GDPR in forwarding your data to third countries;
- Right of rectification in accordance with article 16 GDPR: you have the right incorrect data relating to you for immediate rectification and/or completion of your incomplete data stored by us.
- Right to cancellation in accordance with article 17 GDPR: you have the right to require the deletion of your personal data when the conditions of article 17 para. 1 GDPR. This right however in particular then does not exist, if the processing to the exercise of the right to freedom of expression and information, to comply with a legal obligation, for reasons of public interest or to claim, exercise or defence of legal claims is required;
- The Right to restrict the processing pursuant to Art. 18 GDPR: You have the right to request the restriction of the processing of your personal data as long as the accuracy of your data contested is verified, if you refuse to delete your data due to inadmissible data processing and instead request the restriction of the processing of your data, if you need your data to assert, exercise or defend legal claims, after we no longer need this data after the purpose has been achieved or if you have filed an objection for reasons of your particular situation, as long as it has not yet been determined whether our legitimate reasons predominate;
- If you have exercised your right to have the responsible party correct, delete or limit the processing, this party is obliged to inform all recipients to whom the personal data that concerns you has been disclosed of this correction or deletion of the data or restriction on processing, unless this proves impossible or involves a disproportionate effort. It is your right to have the responsible party inform you regarding such recipients.
- You have the right to receive the personal data you have provided to us in a structured, current and machine-readable format or to request its transfer to another responsible person, insofar as this is technically feasible.
- Right to revoke consents granted in accordance with Art. 7 para. 3 GDPR: You have the right to revoke consent to the processing of data at any time with effect for future for the future. In the event of revocation, we will delete the data concerned without delay, unless further processing can be based on a legal basis for processing without consent. The withdrawal of consent shall not affect the lawfulness of processing based on consent before its revocation.
- Right of appeal under Art. 77 GDPR: If you believe that the processing of personal data concerning you is contrary to the GDPR, you have the right of appeal to a supervisory authority, in particular in the Member State where you reside, work or suspected infringement, without prejudice to any other administrative or judicial remedy.

13) Duration of Storage of Personal DataThe duration of the storage of personal data is determined by the respective legal retention period (e.g. commercial and tax retention periods). After expiry of this period, the corresponding data will be routinely deleted, provided they are no longer necessary for the performance or initiation of the contract and/or there is no longer any legitimate interest on our part in the further storage.
